These Terms and Conditions ("Terms") govern the use of this website and all services provided by The Travel Morena, a trade name (DBA) of Moreno Enterprise Group, LLC ("The Travel Morena," "we," "us," or "our").

 

By accessing this website, requesting a Travel Planning & Quote, submitting a form, authorizing payment, purchasing merchandise or digital products, enrolling in programs, or booking travel services with The Travel Morena, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

These Terms and Conditions may be updated periodically to reflect changes in our services, business practices, and applicable policies. The most current version will always be available on our website.

1. Our Role as Your Travel Advisor

• The Travel Morena operates as an independent travel advisor affiliated with Xstream Travel.

• The Travel Morena acts solely as a travel advisor and booking agent.

• We do not own, operate, manage, or control airlines, cruise lines, hotels, resorts, transportation providers, tour operators, event venues, or other travel suppliers.

• All travel arrangements are subject to the individual terms, conditions, policies, and requirements of the applicable travel supplier.

• The Travel Morena specializes in cruise travel, group travel experiences, and customized travel planning.

• We provide planning, coordination, and booking support designed to simplify the travel process and enhance the overall client experience.

• While we work to provide accurate information and support throughout your travel journey, final decisions regarding supplier policies, travel requirements, and personal travel arrangements remain the responsibility of the traveler.

2. Client Responsibilities

• You are responsible for providing accurate legal names, dates of birth, contact information, and personal details exactly as they appear on government issued identification.

• You are responsible for reviewing all travel documents, payment schedules, deadlines, and requirements related to your reservation.

• You are responsible for ensuring passports, visas, identification, vaccinations, health requirements, and entry requirements are completed prior to travel.

• Any penalties, fees, delays, denied boarding, or losses resulting from incorrect, incomplete, or missing information provided by you are your responsibility.

• If another person books travel on your behalf, you are still responsible for reviewing and agreeing to all applicable policies before submitting payment.

3. Travel Agent Mentorship and Business Support

• The Travel Morena provides optional mentorship, coaching, and business support to independent travel agents who choose to affiliate with Xstream Travel.

• This mentorship is separate from and independent of Xstream Travel’s training, policies, compliance requirements, and supplier education.

• The Travel Morena does not provide supplier training, booking instruction, platform training, or operational travel training.

• All supplier education, platform training, compliance requirements, and travel related instruction are provided solely by Xstream Travel.

• Travel agent mentorship offered by The Travel Morena focuses on business development, marketing strategy, systems, mindset, organization, and professional growth.

• Agents participating in mentorship, cohorts, or referrals operate as independent business owners and are not employees, partners, or representatives of The Travel Morena.

• Each agent is solely responsible for their own business operations, licensing, compliance, finances, marketing, client relationships, and business results.

• The Travel Morena may receive commission or referral compensation for adding agents to the Xstream Travel organization.

• Mentorship, coaching, or support does not guarantee income, sales, business success, or profitability.

• Any examples of results, earnings, or growth are not guarantees and should not be interpreted as typical outcomes.

• Business success requires individual effort, consistency, time, financial investment, and execution.

• One on one mentorship, group coaching, and business support are provided for educational and informational purposes only.

• The Travel Morena is not responsible for the performance, decisions, liabilities, or outcomes of independently operated travel agent businesses.

4. Payments and Authorization

• By submitting payment information, you authorize charges for Travel Planning & Quote Fees, deposits, final payments, service fees, merchandise purchases, digital products, and supplier charges.

• Authorization applies to secure payment portals, invoices, checkout pages, written approvals, and verbal payment authorizations provided directly by the client. By providing payment authorization through any of these methods, you authorize The Travel Morena to process the agreed upon charges.

• Travel Planning & Quote Fees are non-refundable and compensate The Travel Morena for the time, research, and expertise required to prepare personalized travel options. Payment of a Travel Planning & Quote Fee does not guarantee that a reservation will be made.

• Payment schedules and deadlines are provided at the time of booking or purchase.

• Failure to submit required payments by stated deadlines may result in cancellation by the supplier or provider, with applicable penalties applied.

• Payments submitted toward travel, products, or services are subject to the applicable policies outlined in these Terms and Conditions.

5. Pricing and Availability

• All pricing is subject to availability until payment is received and booking or purchase is confirmed.

• Prices may change due to supplier pricing updates, promotions ending, taxes, fees, fuel surcharges, currency fluctuations, or availability changes.

• Cruise and group travel pricing, cabin inventory, availability, and group amenities are capacity controlled and not guaranteed until your reservation has been confirmed.

• Promotional pricing, discounts, and special offers may have specific restrictions and may not be combined with other offers unless stated otherwise.

6. Changes and Modifications

• Any changes requested after booking are subject to supplier policies, availability, and applicable fees.

• Group reservations may have additional restrictions due to contracted rates, limited inventory, and group requirements.

• The Travel Morena will review all requested changes and assist whenever possible; however, changes cannot be guaranteed.

• Service fees charged by The Travel Morena are non refundable regardless of supplier flexibility.

7. Refund Policy and Travel Insurance

• The Travel Morena does not issue refunds under any circumstances
• All refunds, credits, or future travel vouchers are determined solely by the travel supplier or product provider
• We may advocate on your behalf to request a refund or credit, but approval is never guaranteed
• We are not responsible for denied refunds, delayed refunds, partial refunds, or supplier imposed restrictions
• Because refunds are never guaranteed, travel insurance is strongly recommended and may be required for certain trips or group travel

• Travel insurance should be reviewed carefully, as coverage, exclusions, and claim decisions are determined solely by the insurance provider.
• If travel insurance is declined, you accept full financial responsibility for all costs, penalties, and losses

8. Cancellations

• All cancellations are subject to the supplier’s cancellation policies

• Group reservations may have different cancellation policies than individual bookings.
• Cancellation penalties may be up to 100 percent of the total booking cost
• Service fees are non refundable for any reason

9. Merchandise and Digital Products

• All merchandise and digital product sales are final unless otherwise stated in writing
• We are not responsible for delivery delays, manufacturer defects, or third party fulfillment issues
• Chargebacks for merchandise or digital products are not permitted for valid, authorized purchases

10. COURSES AND LIVE MENTORSHIP PROGRAMS

• All course, cohort, accelerator, and live mentorship enrollments with The Travel Morena are final
• Due to the digital nature of these programs and limited live capacity, all payments are non refundable and non transferable
• Enrollment secures your seat in the selected program and refunds will not be issued for missed sessions, scheduling conflicts, dissatisfaction, personal obligations, or changes in circumstance
• In the event of a documented emergency beyond your control, such as the death of an immediate family member, you may request a one time transfer to the next available session of the same program
• Official documentation may be required and approval of any transfer is at the sole discretion of The Travel Morena
• All course materials, frameworks, templates, recordings, mentorship content, and intellectual property are owned exclusively by The Travel Morena
• Duplication, reproduction, redistribution, resale, recording, sharing, teaching, or creating derivative works based on any portion of these programs is strictly prohibited
• Access to any course or mentorship grants individual use only and does not transfer ownership or reproduction rights
• Initiating a chargeback or payment dispute without first contacting The Travel Morena to resolve the matter is a violation of this agreement
• The Travel Morena reserves the right to dispute any chargeback and provide these Terms as evidence of agreement

11. Cruise Travel Specific Terms

• Cruise lines reserve the right to modify itineraries, ports of call, schedules, stateroom assignments, dining arrangements, or onboard offerings without prior notice.

• The Travel Morena is not responsible for itinerary changes, missed ports, weather related disruptions, mechanical issues, or decisions made by the cruise line.

• Gratuities, onboard purchases, specialty dining, internet packages, excursions, and optional services are not included unless specifically stated in writing.

• Guests are responsible for completing all required cruise check in procedures and meeting boarding requirements established by the cruise line.

 

12. Group Travel Specific Terms

• Group pricing, amenities, and exclusive experiences are based on contracted group agreements and may differ from publicly available supplier pricing.

• Group pricing and benefits may change if minimum participation requirements are not met.

• Group deposits are typically non refundable unless otherwise stated in writing.

• Roommate matching is not guaranteed unless confirmed in writing.

• Guests traveling in double occupancy accommodations remain financially responsible for their reservation if their roommate cancels or is unable to travel.

• Name changes may be permitted by the travel supplier but may be subject to fees, restrictions, or penalties.

• Group event schedules, activities, and inclusions are subject to change based on operational needs or circumstances beyond The Travel Morena's control.

13. Force Majeure

• We are not responsible for events beyond our control including weather, pandemics, government actions, labor disputes, mechanical failures, or natural disasters

• Compensation, refunds, or credits are limited to those offered by the applicable travel supplier, insurance provider, or other third party.

14. Chargebacks and Disputes

• You agree not to initiate chargebacks or disputes for valid, authorized charges
• Chargebacks may result in termination of services and recovery of associated costs

• Clients agree to contact The Travel Morena to attempt to resolve any billing concerns before initiating a payment dispute.

15. Communication

• Email is the primary form of communication.

• Response times may vary based on business hours, travel volume, supplier availability, and clients actively traveling.

• Clients currently traveling may receive priority support.

• Urgent requests should be clearly identified in writing.

• Clients are encouraged to review available trip resources, FAQs, and trip specific information before requesting support.

16. GENERAL PROVISIONS

• These Terms and Conditions are intended to be enforceable to the fullest extent permitted by applicable law.

• If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
